Complaint:
On February 9, 2000, NFA's Business Conduct Committee ("BCC") issued a Complaint to Futures Trading Group, Inc. ("FTG") and Kerry L. Brewer ("Brewer"). The Complaint alleges that FTG and Brewer used deceptive, misleading and unbalanced promotional material, in violation of NFA Compliance Rules 2-29(b)(1), (2) and (3). Decision:
On May 22, 2000, NFA's Hearing Panel ("Panel") issued a Decision accepting FTG and Brewer's settlement offer in which they neither admitted nor denied the allegations of the Complaint. The Panel ordered that FTG never reapply for NFA membership. The Panel also ordered that Brewer not reapply for NFA membership or associate membership for 30 months from the date of the Decision. This Decision becomes effective June 6, 2000.
